1. Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Client", "you", or "your") and Finance Master Point, LLC, a Utah limited liability company ("Company", "we", "us", or "our"). By accessing our website (financemasterpoint.com), scheduling a consultation, subscribing to a plan, or using any of our financial services, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy.

If you do not agree with any part of these Terms, you must not use our website or services.

4.1 Application & Approval

Loan applications are subject to credit review, income verification, and underwriting by our lending partners. Approval is never guaranteed. Advertised rates and terms are examples and vary based on creditworthiness, loan amount, term, and state regulations.

4.2 Truth in Lending Act (TILA)

Before closing any loan, you will receive a TILA disclosure showing the APR, finance charge, amount financed, total of payments, and payment schedule. Read these disclosures carefully before signing.

4.3 Repayment & Default

You agree to repay the loan according to the agreed schedule. Late payments may incur fees up to 5% of the payment amount (as permitted by state law). Default may result in collection activity, credit reporting, and legal action. Prepayment is permitted without penalty on most products.

4.4 Credit Reporting

Payment history on loans is reported to major credit bureaus. Positive payments can help build credit; delinquencies will negatively impact your credit score.

Investment advisory services are provided by Finance Master Point Advisors, LLC, a registered investment advisor with the SEC. Key terms include:

6.1 Subscription Plans

Monthly and annual subscription fees are billed in advance via credit card, debit card, or ACH. Fees are non-refundable after the first 30 days of any new subscription (our money-back guarantee period).

6.2 Auto-Renewal

Subscriptions automatically renew at the then-current rate unless canceled at least 7 days before the renewal date. Annual subscribers receive a renewal notice 30 days in advance.

6.3 Advisory Fees

Wealth management fees are either flat monthly (per plan tier) or percentage-based (0.50% annually for accounts over $1M), as disclosed in your engagement letter.

6.4 Third-Party Fees

You may incur additional fees from custodians, fund companies, insurance carriers, or government entities. These are disclosed before you commit to any transaction.

12.1 By You

You may cancel any subscription plan at any time through your account dashboard or by emailing support@financemasterpoint.com. Cancellation takes effect at the end of the current billing cycle. Loan agreements cannot be canceled once funded, but may be prepaid at any time.

12.2 By Us

We reserve the right to suspend or terminate your account or service for: (a) breach of these Terms; (b) fraudulent, abusive, or illegal activity; (c) nonpayment; (d) regulatory or legal requirements; or (e) discontinuation of services with 30 days' notice.

12.3 Effect of Termination

Upon termination, you remain liable for any outstanding fees or loan balances. Sections 7–13 survive termination.

13. Dispute Resolution

13.1 Informal Resolution

Before initiating any legal action, you agree to first contact us at legal@financemasterpoint.com and attempt to resolve the dispute informally for at least 60 days.

13.2 Binding Arbitration

Any unresolved dispute arising out of or relating to these Terms or our services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in Sevier County, Utah, or as agreed. Judgment on the award may be entered in any court with jurisdiction.

13.3 Class Action Waiver

YOU AND Finance Master Point AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS AND NOT IN CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTIONS.

13.4 Exceptions

Either party may seek injunctive relief in court for IP infringement, and may bring small claims actions in the county of their residence.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict-of-laws principles. Any legal proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Sevier County, Utah, and you consent to personal jurisdiction there.

15. Modifications

We may modify these Terms at any time by posting a revised version on this page with an updated "Last Updated" date. Material changes affecting active clients will also be communicated via email at least 30 days before taking effect. Your continued use of our services after the effective date constitutes acceptance of the revised Terms.
